Landgate registers lenders’ security electronically. Under the Transfer of Land Regulations 2004, eligible standalone caveats, and lodgements that include mortgages, discharges, transfers, caveats and caveat withdrawals, must be lodged electronically through an electronic lodgment network. The subscriber lodging a caveat certifies they’ve taken reasonable steps to verify the caveator’s identity.

One WA quirk is worth knowing. Landgate checks that a caveat is in the correct form and records it, but it doesn’t assess whether the claimed interest is valid. That’s why we take care to describe our interest properly in the loan documents, so it holds up if it’s ever tested.

The other big change is paper. Since 7 August 2023, duplicate certificates of title have been removed from WA’s titling system. Existing paper duplicates have no legal effect, so if yours is in a safe somewhere, you don’t need to find it.
